Abstract The land exclusion toward etchnic minority in Yogyakarta through Yogyakartas head regional instruction No. K. 898/I/A/1975 is still valid until now. The form of the land exclusion above is where ethnic minority cannot have the land right. The ethnic minority in this research is more specific to the Chinese ethnic who reside in Yogyakarta. This research will see further how the response of Chinese ethnic in facing the exclusion policy related to the land ownership status in Yogyakarta through Yogyakartas head regional instruction No. K. 898/I/A/1975. This research used methodology of case study where the data collection was done by interviewing and collecting the important and relevant documents, archives and literature. The exclusion happened because of two factors namely; First, History, where there is Rejiksblad Kasultanan rule No. 23 of 1925 which was made at Sultan Hamengku Buwono VIII era. Second, Economics / Sociological, where the condition of Chinese ethnic has better economic welfare compared with Indigenous Ethnic. Thus, the Letter of Instruction is maintained until now. It affects the legislation such as there is the dualism policy in Yogyakarta but conflicting. The land exclusion gets various responses from Chinese ethnic. First, Resistance, the resistance was done by non-formal way, namely by doing various ways besides legally to get the land right and the resistance through formal way, namely by taking legal action such as suing the head regional instruction to the court. Resistance other than by non-formal and formal way, exploit the weaknesses of the bureaucracy to get the land right. Second, Adaptation, this process is done in many ways such as making relationship with the King of Yogyakarta, Conciliation adaptation (taking advantage of every opportunity to discuss the problem of exclusion), and Mediation adaptation (sustainability of activities that intersect with two sides which is used for the mediation process to find the best decision for both sides). All the responses which were done by Chinese ethnic to eliminate the land exclusion and to have the land right were failed. Although many Chinese ethnic have the land right, but it was only apparent success as long as the instruction has not been eliminated. It needs political responses to repeal the head regional instruction No. K. 898/I/A/1975 because of the unsuccessfully bureaucracy responses. Key words : Land Exclusion, Response, Chinese ethnic, Resistance, Adaptation
